Welcome to Digital Janitor. These Terms of Use ("Terms") govern your access to and use of Digital Janitor's website, services, and AI-powered website management tools (collectively, the "Service").
By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
Description of Service
Digital Janitor is an AI-powered service that enables users to update and manage their websites through natural language chat commands. Our service:
- Connects to your code repositories (e.g., GitHub)
- Receives instructions via chat platforms (SMS, Slack, Discord, iMessage, etc.)
- Uses AI to interpret requests and generate code changes
- Provides previews of changes before deployment
- Deploys approved changes to your websites
- Maintains version history for easy rollback
Eligibility
To use Digital Janitor, you must:
- Be at least 18 years old or the age of majority in your jurisdiction
- Have the legal authority to bind yourself or your organization to these Terms
- Not be prohibited from receiving our services under applicable law
- Have the right to grant us access to any repositories or services you connect
Your Account
When you create an account, you agree to:
- Provide accurate, current, and complete information
- Maintain the security of your account credentials
- Promptly update any information that becomes inaccurate
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
Pricing and Payment
Early Access: During our early access period, the Service is provided free of charge. We reserve the right to introduce paid plans in the future with reasonable notice.
Paid Plans: When paid plans are introduced:
- Fees will be billed in advance on a subscription basis
- All payments are processed securely through Stripe
- Subscriptions automatically renew unless cancelled
- Refunds are provided at our discretion
- We may change pricing with 30 days' notice
Acceptable Use
You agree to use the Service only for lawful purposes. You may NOT:
- Use the Service to deploy malicious code, malware, or harmful content
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use the Service to infringe on intellectual property rights
- Deploy content that is illegal, defamatory, or violates third-party rights
- Use the Service to send spam or engage in deceptive practices
- Reverse engineer, decompile, or attempt to extract our source code
- Use automated systems to abuse or overload our Service
- Resell or redistribute the Service without authorization
Your Content and Code
Ownership: You retain all ownership rights to your websites, code, and content. We do not claim ownership of any materials you create or manage through our Service.
License to Us: By using the Service, you grant us a limited license to access, copy, and modify your code solely to provide the Service (e.g., to make the changes you request and deploy them).
Your Responsibility: You are solely responsible for:
- The content and code on your websites
- Ensuring you have rights to any content you deploy
- Reviewing and approving changes before they go live
- Maintaining backups of your code and content
AI-Generated Changes
Our Service uses artificial intelligence to interpret your requests and generate code changes. You acknowledge that:
- AI-generated changes may not always be perfect or exactly as intended
- You should always review previews before approving deployments
- We are not responsible for AI misinterpretations of your requests
- The rollback feature is available to undo unwanted changes
- AI outputs may vary and are not guaranteed to be consistent
Third-Party Services
The Service integrates with third-party services such as GitHub, Slack, Discord, and others. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services or their availability.
Intellectual Property
The Service, including its original content, features, functionality, branding, and code (excluding your content), is owned by Digital Janitor and protected by copyright, trademark, and other intellectual property laws.
The Digital Janitor name, logo, and mascot are our trademarks. You may not use them without our prior written permission.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:
- The Service will be uninterrupted, secure, or error-free
- Results from using the Service will be accurate or reliable
- AI-generated changes will be free of bugs or security vulnerabilities
- The Service will meet your specific requirements
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGITAL JANITOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, or business opportunities
- Website downtime or deployment failures
- Damage to your websites or code from AI-generated changes
- Security breaches resulting from deployed code
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 if you are on a free plan.
Indemnification
You agree to indemnify and hold harmless Digital Janitor, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Content you deploy through the Service
- Your violation of any third-party rights
Termination
You may terminate your account at any time by contacting us or through your account settings. We may suspend or terminate your access immediately, without notice, if you violate these Terms.
Upon termination:
- Your right to use the Service will immediately cease
- We may delete your account data after a reasonable period
- Provisions that should survive termination will remain in effect
Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Your continued use after changes constitutes acceptance. If you disagree with changes, you must stop using the Service.
Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Delaware.
